This agreement is between Samsari AS ("Samsari", "we") and you or the business you represent ("the customer", "you").
About the service
Samsari is a service that helps businesses build, publish and keep websites and content up to date. The service is provided "as is", and we work continuously to improve and develop its functionality.
We may make changes to the service, including adding, changing or removing functionality, without this being considered a material change to the terms, as long as the core functionality is maintained.
Creating an account
To use Samsari, you must create a user account. You must be at least 18 years old, or have authority to enter into agreements on behalf of the business you represent.
You are responsible for any activity that occurs on your account. If you discover unauthorized use of your account, you must notify us immediately at oliver@samsari.no.
Your obligations
When using Samsari, you agree to
- provide accurate and up-to-date information about yourself and your business
- keep your login credentials confidential and not share your account with others
- not use the service for unlawful purposes or to publish content that infringes on others' rights
- not attempt to circumvent security measures or place undue load on the service, for example through automated requests
- be responsible for the content you create and publish through the service
Our obligations
We agree to
- do our best to ensure the service is available and works as described
- notify you of planned maintenance that may affect availability, when practically possible
- process your personal data in accordance with our privacy policy
- notify you in reasonable time before material changes to the terms take effect
Content and intellectual property
You retain ownership of the content you upload or create in Samsari, such as text, images and other material related to your business. By using the service, you grant us a limited right to store, process and display the content to the extent necessary to deliver the service to you.
Samsari, including the platform's design, functionality and underlying technology, is owned by Samsari AS or our licensors. You are granted a non-exclusive, non-transferable right to use the service for as long as the agreement runs.
Pricing and payment
Prices for Samsari are set out in our then-current price list, or as communicated to you when ordering. We may change prices with [FILL IN NOTICE PERIOD] notice before the next billing period.
In the event of late payment, we may restrict or suspend access to the service until the outstanding amount has been settled.
Term and termination
The agreement runs until terminated by you or us. You can cancel your account at any time through the service or by contacting us. The notice period for termination is [FILL IN NOTICE PERIOD].
We may terminate or temporarily suspend your account if you breach material terms of this agreement, or in the event of non-payment. Where practically possible, we will notify you first and give you a deadline to remedy the situation.
Upon termination of the agreement, you may request an export of your content within [FILL IN NUMBER] days, unless otherwise stated in our privacy policy.
Limitation of liability
We strive for high uptime and stable operation, but cannot guarantee that the service will always be error-free or uninterrupted. We are not liable for indirect losses, such as lost profits or data loss, arising from use of the service.
Our total liability to you is in any case limited to [FILL IN AMOUNT/PERIOD], unless the loss is due to gross negligence or intent on our part.
Changes to the terms
We may update these terms in the event of changes to the service or applicable law. In the event of material changes, we will notify you by email or within the service in reasonable time before they take effect. Continued use of the service after the changes take effect constitutes acceptance of the new terms.
Governing law and dispute resolution
This agreement is governed by Norwegian law. Disputes that cannot be resolved amicably may be brought before the ordinary Norwegian courts, with the venue of Samsari AS as the proper venue.
